Elysian Academy – Terms and Conditions 

By completing a booking, you agree to be bound by these Terms. 

1. Definitions 

1.1 Platform refers to the Elysian Academy website, elysianacademy.online, and any third-party platforms used for delivery (e.g. Zoom, Microsoft Teams).  

1.2 Course/Event means any online course, training session, workshop, or live event purchased or attended by the User.  

1.3 Content includes educational materials provided as part of a Course/Event, such as videos, documents, slides, recordings, and assessments.  

1.4 User/Customer refers to the individual, organisation, or company making the booking and responsible for payment and compliance with these Terms. 

2. Booking and Confirmation 

2.1 All bookings are provisional until full payment is received or otherwise agreed in writing.  

2.2 Upon payment, confirmation and access instructions will be sent via email.  

2.3 Courses are primarily delivered through elysianacademy.online, with some sessions hosted on third-party platforms.  

2.4 Completion of booking confirms acceptance of these Terms. 

3. Access and Use 

3.1 Users are granted a non-exclusive, non-transferable licence to access purchased content for personal or professional learning.  

3.2 Login credentials must not be shared. Multiple participants require individual registrations unless agreed in writing.  

3.3 Content may not be copied, reproduced, distributed, resold, or commercially exploited without prior written consent.  

3.4 Elysian Academy reserves the right to suspend or terminate a User’s access to the learning platform, course materials, or live sessions at any time and without prior notice, where such action is deemed reasonably necessary. This includes, but is not limited to, instances of breach of these Terms, misconduct, non-payment, or any other circumstance that, in our sole discretion, compromises the integrity, safety, or lawful operation of our services. 

4. Intellectual Property 

4.1 All Content remains the intellectual property of Elysian Academy or its licensors. Licensors refer to third-party providers such as Absorb LMS who may host or deliver content but do not retain ownership of Elysian Academy’s original materials. 

4.2 Users may download and print materials for personal study.  

4.3 Users may not republish, alter, or redistribute Content.  

4.4 Users may not use Content for illegal, competitive, or unauthorised purposes. 

5. Course and Event Delivery 

5.1 Delivery formats may include live online sessions (scheduled or ad hoc), on-demand content via elysianacademy.online, downloadable resources, and practical on-site learning at designated Elysian Academy locations. We reserve the right to modify, substitute, or adapt the delivery format at our discretion, where reasonably necessary to ensure continuity, accessibility, or quality of service. 

5.2 We make reasonable efforts to ensure access and availability but cannot guarantee uninterrupted service due to technical issues, weather, or other circumstances beyond our control.  

5.3 Content may be updated periodically to maintain relevance and accuracy. 

5.4 Time-Limited Access. Courses have a set time limit for completion and access to course materials. The specific time limit for each course is clearly stated in the course description prior to purchase. It is the User’s responsibility to review and complete the course within the stated timeframe. Access beyond this period may not be available unless otherwise agreed in writing 

6. Cancellations and Refunds 

6.1 Consumers may cancel within 14 days of booking under UK Consumer Contracts Regulations, provided the course has not been accessed, started, or downloaded.  

6.2 No refunds will be issued once a course or event has commenced or content has been accessed.  

6.3 Business Clients (defined as organisations purchasing services for multiple users or under a corporate agreement) may be subject to separate contractual terms which supersede this clause where agreed in writing. 

6.4 If Elysian Academy cancels or reschedules an event for reasons beyond its control, you will be offered a refund or transfer. 

7. Payments 

7.1 Full payment is required at the time of booking unless otherwise agreed in writing. Payments are processed securely via elysianacademy.org using trusted third-party providers such as Stripe or PayPal. While we take reasonable steps to ensure secure transactions, we do not accept liability for any loss resulting from failures or breaches by these payment processors. 

7.2 Corporate clients (defined as registered companies or institutions seeking invoicing arrangements) may apply for invoicing or credit facilities, subject to approval and credit checks. 

7.3 All fees must be settled prior to the event or access being granted. 

8. User Conduct 

8.1 Users must provide accurate registration information.  

8.2 Users must treat trainers, facilitators, and participants with respect.  

8.3 Users must not record, distribute, or share sessions without permission.  

8.4 Users must not engage in disruptive, abusive, or unlawful behaviour.  

8.5 Failure to comply may result in removal from the course or event without refund. 

9. Privacy and Data Protection 

9.1 We comply with the UK GDPR and Data Protection Act 2018.  

9.2 Personal data is processed solely for the delivery of the Course/Event and in accordance with our Privacy Policy.  

9.3 Live sessions may be recorded for quality assurance, learning enhancement, or accessibility purposes. Users will be notified in advance of any recording. By booking and attending a course or event, you acknowledge and consent to such recordings, which may be used in accordance with our Privacy Policy. 

10. Limitation of Liability 

10.1 We shall not be liable for any technical issues beyond our reasonable control, loss of data, business interruption, or any indirect, incidental, or consequential damages, except where such exclusion is prohibited by law. 

10.2 To the fullest extent permitted by law, our total liability to you in connection with any Course or Event shall not exceed the amount paid for that specific Course/Event. 

11. General 

11.1 These Terms are governed by the laws of England and Wales. 11.2 Any disputes shall be subject to the exclusive jurisdiction of the English courts. 11.3 We reserve the right to amend these Terms at any time. Continued use of our services constitutes acceptance of any updated Terms. 

 

11.4 We aim to make our courses accessible to all users. If you require reasonable adjustments due to disability or other access needs, please contact us before booking to discuss any reasonable adjustments you may require. 

11.5 Completion certificates or accreditation may be issued subject to meeting specified criteria, including attendance, participation, and assessment outcomes. Elysian Academy reserves the right to withhold certification where these criteria are not met. 

11.6 Some services may be delivered via third-party platforms. We are not responsible for the availability, functionality, or terms of use of these external services. 

11.7 By registering, you consent to receive essential service communications. You may also opt in to receive marketing updates, which you can unsubscribe from at any time. 

11.8 We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, or government restrictions.
